The Act gives effect to the provisions of Section 32 of the Constitution, which provides for the right of access to information held by the State and to information held by another person that is required for the exercise and/or protection of any right of access to information.

Section 10 of the Act requires a guide that must be published by the Human Rights Commission. Enquiries can be addressed to the SAHRC:

4. PROCEDURE FOR REQUESTING ACCESS
The requester must use the prescribed form to make the request. The request must be made to the CEO at the address or electronic mail address provided in Section 1.
5. REFUSAL OF ACCESS
Access to a record may be refused on grounds set out in the Act, including the protection of privacy or commercial confidentiality.
6. AVAILABILITY OF THE MANUAL
This manual is available for inspection at the offices of the Company free of charge and on the Company website.
